ND Prosecutors in Fargo to Drop Fake Pot Charges

Prosecutors in Cass County will drop all current synthetic marijuana cases because of a recent ruling questioning the state ban on it, but the criminal cases could resume this fall.

Cass County State`s Attorney Birch Burdick said Tuesday that he wouldn`t appeal Judge Wickham Corwin`s recent order dismissing two cases. Corwin said the North Dakota Board of Pharmacy did not properly notify the public after it adopted an emergency rule Feb. 25 banning the product commonly known as Spice or K2.

Burdick says he will respect Corwin`s ruling, and he will ask to have any convictions for synthetic marijuana possession vacated. But Burdick says that once the rule banning synthetic marijuana becomes final Oct. 1, Cass County will resume enforcement.
