Supreme Court Throws Out Measure 2 Case

The North Dakota Supreme Court unanimously threw out a case against public officials over Measure 2. Empower the Taxpayer had argued that Cory Fong and members of other state and local agencies were illegally using taxpayer money to campaign against the measure, which calls for abolishing property taxes in the state.

Voters will decide on Measure 2 on Tuesday.

A district court judge had earlier thrown out the case, saying the group did not have the proper standing to file the case. The Supreme Court agreed.

In an opinion, the justices wrote that it was unnecessary to address other issues raised in the case because they are either unnecessary to the decision, or are without merit.
