Third Day of Beulah Shooting Trial | Video

Retha Colclasure | 6/27/2012

Prosecutors acted out how a shooting in Beulah that left one man dead and another injured happened. One of the two men accused of conspiracy to commit murder took the stand this morning.

Cody Borner and Richard Whitman are accused of conspiring to kill Michael and Timothy Padilla. Timothy survived.

Prosecutors asked Cody Borner where people were standing in the apartment, and how fast it happened. Borner had earlier testified that they went with guns to the apartment to steal a bag of marijuana.

"All it takes for you to get an AR-15 and stick a gun is to get a little bit of weed. You walked in with a gun for a little bit of marijuana. All it takes is a little bit of grass," said McLean County State`s Attorney Ladd Erickson.

Prosecutors asked who was responsible for creating a dangerous situation when two men, one wearing a mask, walked into an apartment with guns. Borner, after first saying there would have been no dangerous situation if the Padilla`s hadn`t rushed at them, then said he didn`t know.
