Attorney Files Motion to Move Murder Trial

The attorney for one of the men charged with the murder of a Sidney, Montana teacher is asking to have his trial moved to a different county.

Al Avignone says he believes his client, Michael Spell, would not receive a fair trial in Richland County, where Sherry Arnold was kidnapped last year.

He's filed a motion to have Spell's trial moved to Gallatin County in Southwestern Montana.   

Avignone says his firm commissioned a survey and found that three-quarters of potential jurors in Richland County may have pre-judged guilt in the case.
    
Prosecutors have until August 31st to contest the motion.
