Hicks Appears in Federal Court

A Nevada man facing murder charges appeared in Federal Court this morning.

Waylon Hicks, 21, is accused of stabbing a man to death on the Fort Berthold Reservation. Prosecutors say Hicks stabbed 30-year-old Jeremiah Sage in July 2012 near the New Town Marina.

The case United States vs Waylon Hicks started this morning with jury selection where they narrowed the pool down from 28 to 12 jurors.

This afternoon they came back and began hearing witnesses in the case. Hicks is accused of second degree murder of 30-year old Jeremiah Sage.

What they say transpired on the night of July 20th, 2012 was that Hicks and Sage met at a bar in New Town where they were drinking until between 1 and 2 a.m. That's when they left, and Sage offered Hicks a ride to his car. Sage let Hicks drive his truck for a bit, and they switched at some point when Sage said Hicks was going the wrong direction.

Sage then began driving and took Hicks down by the marina where they went to the bathroom. When they got back in the truck Hicks says Sage tried to sexually assault him. He told him to stop and pulled out a knife. And when he says Sage didn't stop, he stabbed him twice in the heart.

Hicks then ran out of the truck and says he saw the headlights coming towards him. Thats when the prosecution says Hicks went back to the truck and slashed Sage's throat before fleeing again and calling police.

The defense says he acted in self-defense, but the prosecution says he used force that was not reasonable or necessary.

The trial did recess for today and will continue tomorrow.
